The Workers' Compensation Process in Florida

  1. Notify your employer of your injury. Workers' compensation law requires victims to report their injury within 120 days of the incident.
  2. Your employer must immediately report your injury to their insurer or the person responsible for managing their workers' compensation program.
  3. Within 21 days from the date your employer receives notification of your injury, the carrier or your employer must accept or deny liability for the injury.

If the claim is denied, the injured worker has three years to file a claim petition. These claims are normally assigned to a workers' compensation judge and a hearing is scheduled. The judge will listen to evidence from both the claimant and the employer before rendering a decision.
